Terms of Use
This page states the general Terms and Conditions for the use of the #1 Motor Mart Web site. When submitting an order, a checkbox is provided next to the statement: "I have read, understand and agree to the Terms and Conditions stated on the Policies & Legal Stuff page." By clicking the checkbox, you affirm that you agree as with a legal signature to abide and be bound by the stated Terms and Conditions.
The several Terms and Conditions herein may be individually or collectively modified, added to, or deleted without prior notice. With the exceptions of certain financial exceptions noted below, changes to the Terms and Conditions on this page shall be considered to be effective immediately upon being posted to the #1 Motor Mart Web site.

In collecting the material for certain sections of this site, such as the Resource and Humor sections, we have borrowed from many resources as well as our own personal collections. We appreciate the efforts of those who have gone before us in collecting and creating the materials. We endeavored to either request permission for the use or reproduction of any material when it seemed appropriate and to credit any source when applicable, but this was simply, logistically not always possible. Most of the material appeared to be public domain and free for reproduction. If we have erred in this, just let us know, and we will make every reasonable effort to rectify the situation.
Copyright Notice
The material that makes up the bulk of the #1 Motor Mart site is primarily public information available to anyone. The special site images (such as #1 Motor Mart logos) and page layouts are the property of #1 Motor Mart. Unauthorized duplication of #1 Motor Mart generated graphics, page layouts, and other material deemed to be the property of #1 Motor Mart is prohibited without prior written permission.

This site is intended to be a helpful and entertaining resource for the automobile enthusiast. While we do support and hope that you will visit and support our advertisers, we do list sites in other parts of #1 Motor Mart (such as the Resource and Link to Us sections either for purposes of reference or as a courtesy. The presence or absence of a particular site within a certain section should not be taken as either a positive or negative endorsement.

This does not mean that this is a politically correct site. We are neither prudes nor censors and do not live in a bubble. We recognize that the real world is just that - real - and everyday life presents certain situations that most people will find humorous - even if they won't admit it publicly.
Other than the obvious of presenting material that will be useful to anyone interested in automobiles, we reserve the right to screen and either return for editing or reject any submitted material (including ads or links that contains any of the following:
Clearly, this applies primarily to the Humor section though links and inappropriate ads will be deleted or returned with equal zeal.
We solicit your help is keeping our site free of such material. Should something inappropriate slip past us (such as a link to another site), once discovered, we hope you will bring it to our attention immediately. We promise prompt action.
We Are the Judge
The buck stops here!. We are the sole and final judge as to the suitability of any material or site for inclusion in #1 Motor Mart.
This applies equally to fee based as well as free listings. If the offending site relates to a paid ad, then the advertiser will be notified of the problem and given seven (7) days to correct the situation after which time the ad may be discontinued without further notice.
If the difficulty arises from a free advertisement or other listing, the ad may be removed without prior notice.

Site Currency
Unless specifically stated otherwise in an ad, the currency used on #1 Motor Moat in all ads and for payments made to #1 Motor Mart for advertisements is the United States Dollar (US$). Only funds payable in that currency are acceptable to #1 Motor Mart unless prior arrangements are made for payment in an different currency.
Payments
Payment is always due before an ad is posted. We accept payment in US$ only by the following methods:

Rates and Terms
The current rates for all advertising options currently available on #1 Motor Mart is
summarized on the Ad Rate Summary page. These rates and terms are
subject to change without notice.
All other ads (vendor, banner, featured car) are paid on a set period basis (monthly, annually,
or for so many months) and expire after that period.
Renewals
All ads on #1 Motor Mart MUST be renewed at the end of the term of the currently existing ad.
If an ad has been removed because of the advertiser's failure to renew, it must be re-listed as a new ad with the normal fees.
Vendor, Banner, & Featured Car Ads All vendor, banner, and featured car advertisers will receive
a notice (usually via e-mail) that an ad is about to expire.
In the case of ads running six (6) months or more, this will be a few weeks before the expiration date. For shorter term ads,
the advance notification time will be less. Any Payments
should be sent in a timely fashion to continue an ad without interruption.
Advertisers in these ad types who wish to maintain one or more continuously running ads may request to be billed periodically
for the costs of their ads.
With the exception of the waiver of fees of private ads and carry over terms from existing ads, the renewal of ads will be
considered to be a new contract subject to the terms & conditions and rates that are in effect at the time of renewal.
If an advertiser is eligible to renew under a lock-in agreement, and a current promotion offers a lower rate, the ad may be
renewed at the lower rate for the term of the promotion.
Refunds
Refunds for paid ads are provided in the following situations:
Vendor & Banner Ads These ads may be canceled at any time with a full refund of the unused balance for all paid months during which the ad did not appear minus a one (1) month service fee.
In calculating refunds, any promotional credits such as free months are assumed to be at the end of the term.
Also, if an ad has appeared during any part of a month, it will be deemed to have appeared for the entire month and charged accordingly.
Refunds are issued promptly and always by check.
Bad Checks
Having elected to accept personal checks and knowing that time can be of the essence in selling a vehicle,
we have decided not to hold ads until checks clear. We believe that most people, by far, are honest,
and it's not fair to punish all the rest for the few dip-sticks who are not.
So, having said that, if you send us a bad check, the following things happen:
Bad Check Bums
The following people have attempted payment for ads on #1 Motor Mart using bad personal checks that bounced all over our bank!

Basically, it's all just fair and honest common sense, but we still have to set it our here
to help should any conflicts or misunderstanding arise. The topics covered include
Ad Reference Number
Every ad on #1 Motor Mart is given a seven-digit Ad Reference Number.
This number will look something like this
This interpretation of this (or any) Ad Reference Number is actually very simple. The first five digits are the date your ad is posted,
and the last two digits are in-house reference numbers. (Occasionally, an eight digit or letter
may appear at the end of the usual seven.)

Your Ad Reference Number is used to identify everything on our system relating to your
specific ad. For example, if you have photos or a Web page, these will be identified
by using this number. Using the number above, your Web page would have the file name
and your images would be labeled
If you select a Featured Car option, this will be linked to your
classified ad (or Web page) with this number. And, of course, we will use this number in
our financial records to identify your ad.
Your Ad Reference Number will be sent to you by e-mail as soon as your ad is posted;
however, in most cases, you will also be able to see your number in your ad. If you have more than one ad
on #1 Motor Mart, you will have a separate Ad Reference Number for each ad.
It is very important that you record the Ad Reference Number in case you need to
contact us about your ad.
The Ad Reference Number will be posted in all private classified ads will not appear in
vendor listings.
Passwords
Should you need to Change or Cancel Ad,
we will need a way to verify that it really is
you making the request. We will make use of the tried and tested password. When
you place the order for any ad, you will be asked to enter a password and then a short
sentence of how we can remind you of your password should you forget it. We will refer to
this as the "Password Reminder Sentence."
If you then at some future date forget your password, we will e-mail you with this
sentence to remind you of your. So, make it a good one that you won't forget.
You have heard this before, but remember that passwords should not be the obvious things
like your birth date, your spouse or kid's names, etc. You might pick something like
your first childhood pet or maybe Robert Louis Stevenson's middle name spelled backwards.
In the second case, remember that it doesn't matter if other people know the word - just
as long as they don't have any idea that you selected it.
Posting of Ads
Ads will be posted ASAP once all materials have been received.
This includes the personal info, descriptive text, contact data,
any images to accompany the ad, and, of course, payment. The
term of the ad will not begin until it is actually posted.
Your seven-digit Ad Reference Number
will show the actual posting date which will tell you when your ad
became effective. Refer to the section on the
Ad Reference Number for an explanation
on how to interpret the number.
Arrangement of Ads
Private classified ads will be arranged by date from oldest to newest within
the appropriate make page - i.e., 1955 Ford before 1964 Ford. Two cars of the
same year and make will be place alphabetically by model type. A 1958 Chevy Bel Air
will precede a 1958 Chevy Impala. (Note: Synonyms for the same vehicle will be
considered equal and not distinguished in the list: Chevy = Chevrolet.)
Vendors will be listed alphabetically by business name within the appropriate category.
Featured Cars
Featured Car ads are accepted on a month-to-month arrangement and posted on a first-come, first-served basis should duplicate requests be received for the same space.
The maximum available space is as follows:
In case of a conflict, renewal of presently displayed Featured Car listings and requests from current #1 Motor Mart advertisers will be given priority.

Referral Listings
Referral Listings are offered to give our classified advertisers who prefer it, the option of privacy by not listing personal contact information on ads.
The system is a simple, commonly used one that makes use of e-mail forwarding. We simply insert a #1 Motor Mart e-mail address into the ad text
as a contact e-mail and then have any messages forwarded to an address you provide.
While this method is generally very reliable and widely accepted and used, no procedure is truly foolproof to those who are determined to defeat it.
We offer this option only as a type of shield to assist those who would like the added anonymity and security this technique may provide. We can and
do not guarantee that an advertiser's privacy will be totally anc completely protected.
No Middle Person
We do not interact between buy and seller. All contact and correspondence is strictly
directly between the seller and prospective buyer. We do not intervene or act to facilitate
negotiations in any way. The single exception to this would be in case of a possible misprint
in an ad in which case we would, of course, verify any error on our part.
No Commissions
Since we never take any active part in the negotiations between buyer and seller, we likewise
never collect any commissions on the trades arising from ads that have been placed
on #1 Motor Mart.
Change or Cancel Your Ad
In order to make a change in or cancel your ad, it will be necessary to supply certain
information including your Password.
In general, changes to ads will be limited to a genuine "need to make" basis. This means
changes for such reasons as typos, other errors, information changes (moved), price changes,
or other factual modifications will be permitted. Simply wanting to adjust the wording a bit
or maybe add a little something that was initially forgotten is not a sufficient
reason to change the ad. This means you should be sure you
have it right before submitting. (These limitations do
not apply to changes built into an ad agreement.)
Of course, if you really want to change the text of an ad,
you may do so in any way and for any reason within the guidelines
of the original ad for a $5.00 fee.
We request that you cancel your ad once your vehicle is sold.
Ads may be canceled at any time, but be sure to refer to
our policy on Refunds.
Editorial Changes
Most ads will appear exactly as submitted; however, we reserve the right to make certain editorial changes
in the text of poorly written ads. Such changes may include but not be limited to errors in

If you wish to appear ignorant, this is your right. We will only edit ads when it is truly necessary.

This means that you should be extra careful with this info. If you tell us you are
selling a Jaguar XKF (instead of XKE) or have a typo in your area code or e-mail
address, we will print it "as is." (In a few cases, we might pick up on such errors
and check with you, but don't count on that always happening.)
If an advertiser believes that our changes have an adverse effect on the ad,
a review may be requested. This must be done within thirty (30) days of the date
the ad is posted on #1 Motor Mart.
In some extreme cases, an ad may be returned to the submitting party for revision.
One example where this might occur is if excessive abbreviations are use to try to
get more into the ad making the ad difficult to impossible to read.
Image Submission
If you need to submit one or more images to #1 Motor Mart, you may do so in any of several ways. You may

When submitting images, please be sure to clearly identify yourself and the purpose of the images.
Images should be submitted in a timely fashion. Images for Photo Ads and Web Pages need to be submitted
at the same time as the ad. Photos submitted at a later time may be subjedt to a $3 processing fee.
Image Formats
We prefer that images be submitted to us in either JPG or GIF formats; these are the most common formats use on the Web.
Also, extremely large images will be reduced in size with possible loss in clarity. An image size of 640 x 480 or less
is best.
We can handle and convert most other common formats including BMP and TIF, however, not all work well or interchange
with good success. If you have images in a non-standard format or any doubts, please check with us before sending them.
(Some video cameras save images in a proprietary format; these images should be converted to a common format before they
are sent to us.)
Image Processing
Images submitted to appear on #1 Motor Mart may require a certain degree of
processing such as resizing. For example, photos that appear on Web pages are
resized to a width of 250 pixels.
Normally, we do not crop or otherwise alter the appearance of an image unless
specifically requested to do so. (Occasionally, we crop photos of Featured Cars to
remove excess surroundings.) We never do detailed image processing such as
color adjustments or special effects. If you need this type of work, check with an
professional in this area.

All private classified ads are considered to have a term of one (1) year but may be renewed
thereafter without charge on a year-to-year basis for an effective unlimited term.
Private Classified Ads All private ads (except featured car) MUST be renewed annually in order to
remain on the system. It is the responsibility of the advertiser
to notify #1 Motor Mart that the ad needs to be renewed within thirty (30) days following the expiration date of the ad.
Private Classified Ads & Featured Car There are no refunds for private classified ads once they have been posted.
If we are notified before an ad is actually posted, a full refund will be issued. If a feature car ad has been paid several
months in advance, once posted, a refund will be issued minus any months and fractions thereof during which the ad has appeared.
